Terms and conditions

 

These terms and conditions (“Terms”, “Agreement”) are an agreement between Global Marketing EOOD (“Global Marketing EOOD”, “us”, “we” or “our”) and you (“User”, “you” or “your”). This Agreement sets forth the general terms and conditions of your use of the arbistar.com website and any of its products or services (collectively, “Website” or “Services”).

 

Accounts and membership

 

You must be at least 18 years of age to use this Website. By using this Website and by agreeing to this Agreement you warrant and represent that you are at least 18 years of age. If you create an account on the Website, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it. Providing false contact information of any kind may result in the termination of your account. You must immediately notify us of any unauthorized uses of your account or any other breaches of security. We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions. We may suspend, disable, or delete your account (or any part thereof) if we determine that you have violated any provision of this Agreement or that your conduct or content would tend to damage our reputation and goodwill. If we delete your account for the foregoing reasons, you may not re-register for our Services. We may block your email address and Internet protocol address to prevent further registration.

 

Billing and payments

 

You shall pay all fees or charges to your account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. If, in our judgment, your purchase constitutes a high-risk transaction, we will require you to provide us with a copy of your valid government-issued photo identification, and possibly a copy of a recent bank statement for the credit or debit card used for the purchase. We reserve the right to change products and product pricing at any time. We also reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

To the maximum extent permitted by applicable law, the aggregate liability of Global Marketing EOOD and its affiliates, officers, employees, agents, suppliers and licensors, relating to the services will be limited to an amount greater of one dollar or any amounts actually paid in cash by you to Global Marketing EOOD for the prior one month period prior to the first event or occurrence giving rise to such liability. The limitations and exclusions also apply if this remedy does not fully compensate you for any losses or fails of its essential purpose.

 

Indemnification

 

You agree to indemnify and hold Global Marketing EOOD and its affiliates, directors, officers, employees, and agents harmless from and against any liabilities, losses, damages or costs, including reasonable attorneys’ fees, incurred in connection with or arising from any third-party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your Content, your use of the Website or Services or any willful misconduct on your part.

 

Severability

Dispute resolution

 

The formation, interpretation, and performance of this Agreement and any disputes arising out of it shall be governed by the substantive and procedural laws of Sofija grad, Bulgaria without regard to its rules on conflicts or choice of law and, to the extent applicable, the laws of Bulgaria. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the state and federal courts located in Sofija grad, Bulgaria, and you hereby submit to the personal jurisdiction of such courts. You hereby waive any right to a jury trial in any proceeding arising out of or related to this Agreement. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.

 

Changes and amendments

 

We reserve the right to modify this Agreement or its policies relating to the Website or Services at any time, effective upon posting of an updated version of this Agreement on the Website. When we do we will send you an email to notify you. Continued use of the Website after any such changes shall constitute your consent to such changes.

 

Acceptance of these terms

 

You acknowledge that you have read this Agreement and agree to all its terms and conditions. By using the Website or its Services you agree to be bound by this Agreement. ARBISTAR 2.0, is a company specialized in the development and promotion of semiautomated cryptocurrency applications; Our work focuses on developing for its subsequent commercialization, to synchronize with their Exchanges, through an arbitration Robot that connects several times a day, which It allows detecting the price difference of a cryptocurrency in several exchanges, facilitating the user the purchase, as well as the sales, obtaining the greatest benefits, in his own personal exchange, with the control and under the absolute responsibility of the client-user, so that the use that the client makes of it, exonerates us from all responsibility.

ARBISTAR 2.0, only relinquishes the use of this software, with a limited duration, so it is merely the provider of the software, maintaining the ownership thereof, with the conditions set out below.

Our product operates only in the cryptocurrency market, with the exchange of cryptocurrencies and commercial cryptocurrencies.

 

PROPERTY OF THE SOFTWARE and SCOPE OF AUTHORIZED USE:

 

From the moment of signing the service agreement with the commercial ARBISTAR 2.0 for the software license, the client is expressly authorized to market and exchange in his own name, in the 13 accepted cryptocurrency exchanges, in the different markets, as well as for the commercial arbitration of cryptocurrency.

Arbistar 2.0, only relinquishes the use of said Software, in such a way that the use of its Bitcoin will be under its

responsibility, at all times refraining from altering, modifying or plagiarizing, with or without profit motive, said license, as well as sublicense in any way the computer programs under license, commercialize, or assign to third parties for commercialization.

Any intellectual or property right belongs to the ARBISTAR 2.0 provider.

The breach of contract, as well as the violation of copyright, patents and trademarks, will generate the exercise of the actions contemplated in the internal regulation, with the pertinent civil and criminal responsibilities provided for in the Civil Code and in the Royal Legislative Decree 1 / 1996, of April 12, which approves the revised text of the Intellectual Property Law,

 

PROHIBITIONS

 

Notwithstanding everything stipulated in the previous paragraph, the use of the Software to manage the Capital of third parties is expressly prohibited.

 

VALIDITY

 

This license allows you to use bot software, personally and non- transferable, for one year (24 months) to compute from the signing of the contract that both parties will subscribe, therefore THE LICENSE OF USE IS NOT PERPETUAL.

In case of business succession, there is no transmission of this software license, but it will be understood that the signed contract has been finalized, and another formal and legally distinct contract will be started through a new contract, even if the services or business activity are the same that they were lending.

 

CONFIDENTIALITY

 

The client undertakes not to disclose the information provided by ARBISTAR 2.O and that is identified by it as “Confidential”, with the exception of information that is public domain.

 

NEW VERSIONS, UPDATES AND MAINTENANCE

 

ARBISTAR 2.O will inform the user of any update, or new version that implies an improvement in the Software, without requiring to be formalized in an additional contract.

 

 
ANNEX I
 

Guidelines for the protection of the brand, images, logos, names and official references of Arbistar 2.0
 
This agreement forms the ANNEX I of the “Agreement of Terms and Conditions” of Arbistar 2.0Arbistar 2.0 is a registered trademark of “Global Marketing EOOD” and whose official domain is www.arbistar.comThrough this agreement, the guidelines for the protection of the brand, images, logos, names and official references of Arbistar 2.0 are established, which is subject to the following clauses:
 
1. The images, logos, names and official references of Arbistar 2.0 can only be used on the official site of Arbistar 2.0 and any other means that Arbistar 2.0 officially provides.
 
2. The use of images, logos, names and official references of Arbistar 2.0 by any natural or legal person other than Arbistar 2.0 is strictly prohibited.
 
3. The only images and logos available for use by customers or not, are those that Arbistar 2.0 places in the “Marketing” section of each client’s personal office.
 
4. The images and logos referred to in the previous clause must be used as follows, without exceptions:- They must keep the definition in pixels per inch- Must be according to the chosen use- They must keep the proportions- They must preserve the range of colors- They must keep all the original legends of the images- They can not be treated with any kind of effect- They can not be overprinted with any image or caption- Can not be cut or partially used- They can not be used in contexts where reference is made to activities outside of Arbistar 2.0- They can not be used in contexts where reference is made to illicit, defamatory, offensive, erotic, pornographic or contrary activities to good practices and customs normally accepted.- Arbistar 2.0 may have unique formats for the use of users in their social networks whatever they may be and in order to preserve a homogeneity and image of the brand in the networks, this material may be found once arranged in the section ” Marketing “of the personal BackOffice of each user.
 
5. Any website that uses the name of Arbistar 2.0, with the objective of recommending its products and services or making any exclusive reference to the Company, whether or not belonging to any client / partner of Arbistar 2.0, must comply with the following requirements:- You must request approval from Arbistar 2.0 for the correct use of images, logos and official company names.- Without prejudice to the images, templates and other graphic elements used in the website considered, whenever reference is made to Arbistar 2.0; reference should be made to the logos, images and names authorized by Arbistar 2.0 as stipulated in clauses 3. and 4. of this annex.- It must be absolutely clear, by the name of the domain, that the site does not officially belong to Arbistar 2.0- The use of brand, images, logos, names and official references of the Company in sites with “Homonymous Domains” and all its subdomains is absolutely prohibited; for all extensions. Arbistar 2.0 recognizes the freedom of people to register homonymous domains and does not interfere in it; however, it does not allow the use of its trademark, images, logos, names and official references of the Company, in those domains, considering that it can be confused by its clients.- Homonymous domains are considered according to the previous point to all possible derivations and subdomains similar to: www.arbistar.com:- Any third party website, Youtube channel or video in it, as well as any digital or printed publication, which refers to Arbistar 2.0 with the purpose of recommending its products and services or another objective, must contain and specifically in the websites in its header on all pages and somewhere correctly visible (depending on the aesthetics of each site), in the space that goes from pixel No. 1 to pixel No. 250 height counting from top to bottom; the phrase and / or forms:- “UNOFFICIAL SITE”. The typeface used for such legend is the one that the author considers appropriate according to the aesthetics of the site, but it must be at least size 10 and read correctly.- This preceding point may have the variation of a watermark, distinctive or specific logo that Arbistar 2.0 believes it is convenient to develop at some point to save the image and its homogeneity in the network.- In no way can you copy and paste content extracted from the Official Site of the Arbistar 2.0 Company, indiscriminately. It will only be allowed in case a topic lacks another way of expressing itself or loses explanatory support if expressed in another way or with another syntax. In the latter case, the authorization of Arbistar 2.0 must be mediated as in all cases.- All written or oral references to Arbistar 2.0, as well as to its products, programs or plans, must be made in the third person; that is, with the conjugation of the personal pronoun of the third person plural: “ELLOS”. By virtue of this it can not be done with the conjugation “I”, nor “EL”, nor “WE”, nor “YOU”, nor “YOU”.
 
6. All Group, Page or Similar Social Networks, Blog or Microblogging; that uses the name of Arbistar 2.0, with the objective of commenting on any topic of the Company or recommending its products and services; whether or not it belongs to Clients / Associates of Arbistar 2.0 “. You must meet the following requirements:- You must request approval from Arbistar 2.0 for the correct use of images, logos and official company names- Use for the headers or headings of the groups, pages and / or similar, only and exclusively the images that for this purpose will be available in the “Marketing” section of the Client’s personal office.- Do not use images that refer to illicit, defamatory, offensive, erotic, pornographic or contrary to good practices and customs normally accepted for profile images of groups, pages and / or similar.
 
7. Any website, group, page or similar of Social Networks, Blog or Microblogging that uses the name of Arbistar 2.0, with the objective of commenting on any topic of the Company or recommending its products and services; whether or not it belongs to Clients / Associates of Arbistar 2.0, you must complete the following process in order to be authorized to use the Arbistar 2.0 Brand:
 
7a) Send an email to [email protected] detailing all the details of the owner or owners of the website, page, group or similar social networks, Blog or Microblogging, as well as the complete link to it.
 
7b) Make the suggested changes, inclusions or exclusions. Bearing in mind that said suggestions will always be linked exclusively to the use of the Arbistar 2.0 Brand, logos, images and other references linked to the Company.
 
7c) Once the approval for the use of the Arbistar 2.0 Brand, logos, images and other references linked to the Company has been obtained through an email sent to this end from the address: [email protected], you can start with the promotion of it.8. No process referred to in the preceding clause may be extended for more than five business days. Considering likewise, the lack of response to an email from the Company with the suggestions listed in point 2) of the preceding clause for more than 4
 
8 hours by the interested party, such as abandoning the authorization process.
 
9. Any presentation made in any software for this purpose and intended to be reproduced by digital means, whether audio, video or similar by any means; with the objective of commenting on any topic of the Company or recommending its products and services; whether or not it belongs to Clients / Associates of Arbistar 2.0 “. Without prejudice to the aesthetics adopted for the artistic realization thereof; must contemplate what is stated in clauses 3. and 4. of this Annex, to refer to the brand, logos and images of the Arbistar Company 2.0
 
10. It is not allowed under any circumstance or reason, the transcription or reproduction of this “Agreement of Terms and Conditions” of Arbistar 2.0 by any digital means, either through Internet or other means. The use of the link to the Official Site of the Company where this “Terms and Conditions Agreement” of Arbistar 2.0 is published is permitted.
 
11. Arbistar 2.0 reserves the right to legally act in protection of its brand, logos, images and references, against the owners of websites, groups, pages or similar Social Networks, Blogs or Microbogging, as well as against the holders of the presentations made in any software for this purpose and intended to be reproduced by digital means, whether audio, video or similar by any means; that do not comply with the Compliance, violating the rights of Arbistar 2.0 on its brand, images, logos and references.
 
12. The legal action referred to in the preceding clause will follow the guidelines set forth in the “Conflict Resolution” section of the “Terms and Conditions Agreement” detailed on the official Arbistar 2.0 page.
 
13. All the graphic material that makes reference to Arbistar 2.0, produced by third parties to Arbistar 2.0, whether they are natural or legal persons and whatever the destination of their use; must follow without exception the guidelines stipulated in clauses 3. and 4. of this Annex. Otherwise, Arbistar 2.0 reserves the right to act as established in clauses 11. and 12. of this Annex.
 
14. Any client can request to the mail [email protected] the authorization of presentations made in any software for this purpose and intended to be reproduced by digital means, either audio, video or similar by any means; and of graphic material, whatever the destination of its use. For this request you must detail all the data of the owner or owners plus a very brief explanation of the use to be made of it. The approval will be obtained through an email sent to the owner from the address [email protected]

Pautas para la protección de la marca, imágenes, logos, nombres y referencias oficiales de Arbistar 2.0El presente acuerdo conforma el ANEXO I del “Acuerdo de Términos y Condiciones” de Arbistar 2.0
 
Arbistar 2.0 es una marca registrada de “Global Marketing EOOD” y cuyo dominio oficial es www.arbistar.comPor medio de este acuerdo se establecen las pautas para la protección de la marca, imágenes, logos, nombres y referencias oficiales de Arbistar 2.0,  lo cual está sujeto a las siguientes cláusulas:
 
1. Las imágenes, logos, nombres y referencias oficiales de Arbistar 2.0 sólo pueden ser utilizados en el sitio oficial de Arbistar 2.0 y en cualquier otro medio que Arbistar 2.0 disponga de manera oficial.
 
2. Queda absolutamente prohibido la utilización de imágenes, logos, nombres y referencias oficiales de Arbistar 2.0 por cualquier persona física o jurídica que no sea Arbistar 2.0
 
3. Las únicas imágenes y logos a disposición para el uso por parte de clientes o no, son aquellas que Arbistar 2.0 coloca en la sección “Marketing” de la oficina personal de cada cliente.
 
4. Las imágenes y logos a las que hace referencia la cláusula anterior deben ser utilizados de la siguiente manera, sin excepciones:- Deben conservar la definición en píxeles por pulgada- Deben ser acordes al uso elegido- Deben conservar las proporciones- Deben conservar la gama de colores- Deben conservar todas las leyendas originales de las imágenes- No pueden ser tratadas con ningún tipo de efecto- No pueden ser sobre impresas con ninguna imagen o leyenda- No pueden ser recortadas ni utilizadas de manera parcial- No pueden ser utilizadas en contextos donde se hace referencia a actividades ajenas a Arbistar 2.0- No pueden ser utilizadas en contextos donde se hace referencia a actividades ilícitas, difamatorias, ofensivas, eróticas, pornográficas o contraria a los buenos usos y costumbres normalmente aceptados.- Arbistar 2.0 podrá disponer de formatos únicos para el uso de los usuarios en sus redes sociales cualquiera que sean estas y en pro de conservar una homogeneidad e imagen de la marca en las redes, este material podrá encontrarse una vez dispuesto, en la sección “Marketing” del BackOffice personal de cada usuario.5. Todo sitio web que utilice el nombre de Arbistar 2.0,  con el objetivo de recomendar sus productos y servicios o hacer cualquier referencia exclusiva a la Empresa, pertenezca o no a algún cliente/asociado de Arbistar 2.0, deberá cumplir con los siguientes requisitos:- Debe pedir aprobación a Arbistar 2.0 por el correcto uso de imágenes, logos y nombres oficiales de la Empresa.- Sin perjuicio de las imágenes, plantillas y demás elementos gráficos utilizados en el sitio web considerado, toda vez que se haga referencia a Arbistar 2.0; deberá hacerse referencia con los logos, imágenes y nombres autorizados por Arbistar 2.0 según lo estipulado en las cláusulas 3. Y
 
5. Del presente anexo.- Debe quedar absolutamente claro, por el nombre del dominio, que el sitio no pertenece a oficialmente a Arbistar 2.0- Está absolutamente prohibido el uso de marca, imágenes, logos, nombres y referencias oficiales de la Empresa en sitios con “Dominios Homónimos” y todos sus subdominios; para todas las extensiones. Arbistar 2.0 reconoce la libertad de las personas de registrar dominios homónimos y no interfiere en ello; sin embargo no permite el uso de su marca, imágenes, logos, nombres y referencias oficiales de la Empresa, en dichos dominios por considerar que puede prestarse a confusión por parte de sus clientes.- Se consideran dominios homónimos en función del punto anterior a todas las posibles derivaciones y subdominios similares a: www.arbistar.com: – Todo sitio web de tercero, canal de Youtube o vídeo en el mismo, así como cualquier publicación digital o impresa, que hace referencia a Arbistar 2.0 con el objeto de recomendar sus productos y servicios u otro objetivo, debe contener y en concreto en los sitios web en su encabezado en todas las páginas y en algún lugar correctamente visible (en función de la estética de cada sitio), en el espacio que va desde el pixel Nº 1 al pixel Nº 250 de altura contando desde arriba hacia abajo; la frase y/o formas:- “SITIO NO OFICIAL”. La tipografía utilizada para tal leyenda es la que el autor considere oportuna según la estética del sitio, pero deberá ser como mínimo de tamaño 10 y leerse correctamente.- Este punto precedente puede tener la variación de alguna marca de agua, distintivo o logo específico que Arbistar 2.0 crea conveniente en algún momento desarrollar para guardar la imagen y homogeneidad de la misma en la red.- De ninguna manera se podrá copiar y pegar contenido extraído del Sitio Oficial de la Empresa Arbistar 2.0, de manera indiscriminada. Sólo estará permitido en caso de que un tema carezca de otra forma de expresarse o pierda sustento explicativo si se lo expresa de otro modo o con otra sintaxis. En este último caso, deberá mediar como en todos los casos, la autorización de Arbistar 2.0- Toda referencia escrita u oral, a Arbistar 2.0 como así también a sus productos, programas o planes, deberá realizarse en tercera persona; es decir con la conjugación del pronombre personal de la tercera persona del plural: “ELLOS”. En virtud de esto no podrá realizarse con la conjugación “YO”, ni “EL”, ni “NOSOTROS”, ni “TU”, ni “VOSOTROS”.
 
6. Todo Grupo, Página o Similares de Redes Sociales, Blog o Microblogging; que utilice el nombre de Arbistar 2.0, con el objetivo de comentar sobre cualquier tema de la Empresa o recomendar sus productos y servicios; pertenezca o no a Clientes/Asociados de Arbistar 2.0”. Deberá cumplir con los siguientes requisitos:- Debe pedir aprobación a Arbistar 2.0 por el correcto uso de imágenes, logos y nombres oficiales de la Empresa- Utilizar para las cabeceras o encabezados de los grupos, páginas y/o similares, única y exclusivamente las imágenes que para tal fin estarán disponibles en la sección “Marketing” de la oficina personal de Cliente.- No utilizar para las imágenes de perfil de los grupos, páginas y/o similares, imágenes que hacen referencia a actividades ilícitas, difamatorias, ofensivas, eróticas, pornográficas o contraria a los buenos usos y costumbres normalmente aceptados.
 
7. Todo sitio web, grupo, página o similares de Redes Sociales, Blog o Microblogging que utilice el nombre de Arbistar 2.0, con el objetivo de comentar sobre cualquier tema de la Empresa o recomendar sus productos y servicios; pertenezca o no a Clientes/Asociados de Arbistar 2.0, deberá completar el siguiente proceso para ser autorizado a utilizar la Marca Arbistar 2.0:
 
7a) Enviar un correo a [email protected] donde se detallen todos los datos del titular o titulares del sitio web, página, grupo o similares de redes sociales, Blog o Microblogging, como así también el enlace completo al mismo.
 
7b) Realizar los cambios, inclusiones o exclusiones sugeridos. Teniendo en cuenta que dichas sugerencias siempre estarán ligadas exclusivamente al uso de la Marca Arbistar 2.0, logos, imágenes y demás referencias ligadas a la Empresa.7c) Una vez obtenida la aprobación para el uso de la Marca Arbistar 2.0, logos, imágenes y demás referencias ligadas a la Empresa a través de un correo electrónico enviado a tal fin desde la dirección: [email protected] se podrá comenzar con la promoción del mismo.
 
8. Ningún proceso al que hace referencia la cláusula precedente podrá extenderse por más de cinco días hábiles. Considerando así mismo, la falta de respuesta a un correo de la Empresa con las sugerencias enunciadas en el punto 2) de la cláusula precedente por más de 48 Hs. por parte del o los interesados, como un abandono del proceso de autorización.
 
9. Toda presentación realizada en cualquier software para tal fin y destinada a ser reproducida por medios digitales, ya sea audio, video o similares por cualquier vía; con el objetivo de comentar sobre cualquier tema de la Empresa o recomendar sus productos y servicios; pertenezca o no a Clientes/Asociados de Arbistar 2.0”. Sin perjuicio de la estética adoptada para la realización artística de la misma; deberá contemplar lo expresado en las cláusulas 3. y 4. del presente Anexo, para referirse a la marca, logos e imágenes de la Empresa Arbistar 2.0
 
10. No está permitido bajo ninguna circunstancia o motivo, la transcripción o reproducción del presente “Acuerdo de Términos y Condiciones” de Arbistar 2.0 por ningún medio digital, ya sea a través de Internet u otro medio. Sí está permitido el uso del enlace a la página del Sitio Oficial de la Empresa donde se publica el presente “Acuerdo de Términos y Condiciones” de Arbistar 2.0.
 
11. Arbistar 2.0 se reserva el derecho de accionar legalmente en protección de su marca, logos, imágenes y referencias, contra los titulares de sitios web, grupos, páginas o similares de Redes Sociales, Blogs o Microbogging, como así también contra los titulares de las presentaciones realizadas en cualquier software para tal fin y destinadas a ser reproducidas por medios digitales, ya sea audio, video o similares por cualquier vía; que no cumplen con el Compliance, violando los derechos de Arbistar 2.0 sobre su marca, imágenes, logos y referencias.
 
12. La acción legal referida en la cláusula precedente seguirá los lineamientos de lo estipulado en el Apartado “Resolución de Conflictos” del “Acuerdo de Términos y Condiciones” detallados en la página oficial de Arbistar 2.0
 
13. Todo el material gráfico que haga referencia a Arbistar 2.0, producido por terceros a Arbistar 2.0, ya sean personas físicas o jurídicas y cualquiera sea el destino de su uso; debe seguir sin excepciones los lineamientos estipulados en las cláusulas 3. Y 4. del presente Anexo. En caso contrario Arbistar 2.0 se reserva el derecho de accionar según lo establecido en las cláusulas 11. y 12. del presente Anexo.
 
14. Cualquier cliente puede solicitar al correo [email protected] la autorización de presentaciones realizadas en cualquier software para tal fin y destinadas a ser reproducidas por medios digitales, ya sea audio, video o similares por cualquier vía; y de material gráfico, cualquiera sea el destino de su uso. Para dicha solicitud se debe detallar todos los datos del titular o titulares más una muy breve explicación del uso que se va a realizar de la misma. La aprobación se obtendrá a través de un correo enviado al titular desde la dirección [email protected]
